[UPDATE] Apple wint rechtszaak tegen Samsung

Vannacht deed de jury een oordeel over de rechtszaak tussen Apple en Samsung. De rechtszaak startte enkele weken geleden. Een uitspraak zou pas over een week gedaan worden, maar nu blijkt er al een oordeel te zijn gevallen.

Apple lijkt de grote winnaar in de rechtszaak te zijn, als je kijkt naar hoeveel patenten Samsung geschonden heeft. Apple heeft zelf geen bewijs kunnen aantonen voor het rechtmatig gebruiken van de 3G-claim van Samsung, maar daar blijft het bij. Enkele uitspraken waarmee Apple in het gelijk is gesteld zijn het bounce-back patent, het pinch-to-zoom-patent en het kopiëren van iOS-iconen op Samsungs telefoons. Samsung mag daarnaast geen gebruik meer maken van patenten ‘516 en ‘941. Deze uitspraken waren al te verwachten.

Mocht Apple daadwerkelijk winnen, zouden zij aanvankelijk $1.049.343.540 (1 miljard, 49 miljoen, 343 duizend en 540) (zo’n €838 miljoen euro) + schadevergoeding voor twee producten schadevergoeding krijgen van Samsung. Nu blijkt echter dat de jury een fout heeft gemaakt in de berekening, waardoor het bedrag iets te hoog uitgevallen is. Er volgt momenteel dan ook nog een herziening. De rechter had liever gehad dat ze maandag pas verdergaan, maar dat verzoek is afgewezen. De uiteindelijke uitspraak volgt dus nog vannacht.
